Wehome, Legal Home Sharing Platform of Korea - Effective date: April 1, 2020

Article 1 (Purpose)

These Terms and Conditions of the service are a binding legal rights of wehome (“The Company”) that provides services (“Services”) through the websites, mobile applications in the internet from wehome platform (“wehome”) between users and The Company for the purpose of stipulating obligations and responsibilities.

Article 2 (Definition)

Wehome is a marketplace set up so that the Company can trade goods or services using information and communication equipment such as computers in order to provide goods or services to users. It is also used as the meaning of the business operator that operates.

Users are members and non-members who receive the services provided by the above wehome based on this agreement.

A member is a person who registers with the site by providing his/her personal information, who is constantly provided the information of wehome and who can continuously use the services provided by wehome.

A non-member is a person who uses the services provided by wehome without joining wehome as a member. A guest is a member who books accommodations through wehome.

A host is a person who rents accommodation at wehome as a member. Service fees are fees paid by a guest or host to wehome. Union fees or enrollment fees are fees paid by the guest or host to wehome or the amount paid over a period of time.

Content refers to all member information, accommodation information, usage reviews, photos, videos, VR/AR information, and so on, posted on wehome by the host or guest.

wehome, designated with an ICT regulatory Sandbox by the government, can practice its business under special law: wehome is a legal Home Sharing service provider, providing services to local Koreans and foreigners near the Seoul Subway Station.

The special home sharing business is based on Article 38-2, Paragraph 3 of the “Special Law Regarding Promotion of Convergence and Information and Communication Technology (ICT)” and also based on Article 42-4, Paragraph 5 of “Enforcement Ordinance of the Act Regarding Convergence of New ICT. This is due to the special regulation designation for the demonstration of technical services.

wehome is obliged to comply with the conditions specified by the national demonstration exception.

Article 3 (Statement and Modification of Terms and Conditions)

Wehome provides the services listed as below. o Providing information on goods or services and concluding purchase contracts o Delivery of goods or services for which a purchase contracted, business and services such delivery of service set by wehome Wehome can change the contents of goods and services provided by future contracts in case of out of stock of goods or change of technical specifications. In this case, the contents of the changed goods/services and the date of provision will be clearly stated, and the contents of the current goods/services will be notified to the user. As changing the service provided by wehome and concluding a contract with the user due to reasons such as out of stock of goods or change of technical specifications, wehome shall indemnify the damages incurred by the user, which proves the causal relationship. However, if the loss was not wehome’s fault, wehome has no responsibility to compensate the loss. Wehome provides a platform for users to upload and link content, and the responsibility for the content uploaded by the user lies with the original author who produced and posted the content. Wehome can change and utilize the content posted on wehome. Users are responsible for keeping the information displayed on the wehome website and the information stored by wehome as a record on a storage medium separate from wehome, which is necessary for evidence, accounting, etc.

Article 4 (Service Provision and Change)

Wehome provides the services listed as below.

o Providing information on goods or services and concluding purchase contracts
o Delivery of goods or services for which a purchase contracted, business and services such delivery of service set by wehome

Wehome can change the contents of goods and services provided by future contracts in case of out of stock of goods or change of technical specifications.
In this case, the contents of the changed goods/services and the date of provision will be clearly stated, and the contents of the current goods/services will be notified to the user.

As changing the service provided by wehome and concluding a contract with the user due to reasons such as out of stock of goods or change of technical specifications, wehome shall indemnify the damages incurred by the user, which proves the causal relationship. Wehome provides a platform for users to upload and link content, and the responsibility for the content uploaded by the user lies with the original author who produced and posted the content. 

Wehome can change and utilize the content posted on wehome. Users are responsible for keeping the information displayed on the wehome website and the information stored by wehome as a record on a storage medium separate from wehome, which is necessary for evidence, accounting, etc.

Article 5 (Services Termination)

Wehome can temporarily suspend the provision of services in the event of maintenance, inspection, replacement or failure of information and communication equipment such as computers, or termination of communication.

1. Wehome may limit the provision of services or temporarily suspend the provision of services if the services cannot be provided due to a natural disaster or similar force majeure. In case of service termination according to paragraph 1, wehome will notify the user by the method specified in Article 8.
2. Wehome will compensate for the actual damages incurred by the user or a third party due to the temporary suspension of service provision due to the reason set forth in paragraph 1. However, this does not apply if wehome is not intentional or negligent.
3. If the service cannot be provided due to a change of business type, abandonment of business, integration between vendors, wehome will notify the user by the method stipulated in Article 8 and according to the terms presented by wehome, wehome shall indemnify consumers.

Article 6 (Membership)

The user applies for membership registration by filling out the membership information based on the registration form established by wehome and then expressing the intention to agree to this agreement.

Wehome will be registered as a member unless it falls under any of the following items among the users who applied to register as a member. This does not apply if the applicant has previously lost membership, but if three years have passed since the loss of membership and the consent to re-enroll in wehome has been obtained.
If there are falsehoods, omissions, or typographical errors in the registered information, or if it is judged that registering as a member will significantly hinder wehome’s technology, the consent of wehome will reach the member when the membership registration contract is established. It will be the time when If there is a change in the registered items, the member must immediately notify wehome of the changed items by e-mail or other means.

Wehome can request the host for additional documents and information required for the Wehome Home Sharing Business under special law application and registration process. Wehome can ask guests for a copy of their passport or ID.

Article 7 (Membership Withdrawal And Disqualification)

Members may request wehome to withdraw at any time, and wehome will process the withdrawal after all of the member’s responsibilities have been processed.

However, before notifying the intention to cancel, the transaction of all products currently in progress must be completed, withdrawn or canceled, and the disadvantage of withdrawing or canceling the transaction must be borne by the member himself/herself. It will not be. The member must bear the responsibility for the disadvantage caused by the withdrawal of the member, and The Company can collect various benefits additionally provided to the member when the usage contract is terminated.

 wehome may limit or suspend membership if the member falls under any of the following reasons.

o When registering false information when applying for registration, when registering false information about accommodation facilities
o When a user does not pay the price of goods and services purchased using wehome and other debts borne by the member regarding the use of wehome on the due date
o When threatening the electronic transaction order by obstructing other people’s use of wehome or stealing that information
o When exchanging personal information of wehome members for separate transactions or directing traffic to other sites
o When distorting the transparency of wehome services by posting reviews and ratings of hosts, guests and accommodations in a false manner

wehome may revoke membership if the member falls under any of the following reasons.

o If the same action is repeated more than once after wehome restricts or suspends membership, or if the reason is not corrected within 15 days
o If a user registers an accommodation that he/she does not have legal authority to use and try or succeed in a rental contract

wehome publishes a special license of Wehome Legal Home Sharing under the Regulation Sandbox Policy of the Korean Government. There is a list of conditions in publishing the license. For detail condition refer to    [ ICT Regulation Sandbox Special License (규제 샌드박스 실증특례 지정서) ]  and [ Wehome Legal Home Sharing ].  With any violation  of Wehome Sharing  under the special law, a host’s license  can be suspended or canceled. Followings are  cases resulting suspension or cancellation.   

1. When there is any violation of license condition: the facility, host qualification, and the business scope

2. When the documents submitted by the host, the contents declared, or the information are different from the facts

2. When there is  a serious concern on housing structure (aging, defective), a danger of firefighting management related accidents, or a hygiene management problems
3. If the possibility of operating beyond the registered business scope is perceived
4. If complaints by neighbors around the property continues

5. If the host gets any administrative disposition related to home sharing or accommodation from the local government

6. If transfer, leave or closure due to small information or change of business not declared
7. If the host do business beyond the scope set by the special license by the Government. For example, the host can get the  reservation from the Korean domestic guests only through wehome. 

8. If the host or the facilities do not meet the wehome’s community. 

Article 8 (Notification To Members)

A user must provide the basic information he/she requests on wehome and he/she is legally responsible for the accuracy of the information. Additional information can be provided by wehome’s information policy.
The user must not enter any information unrelated to the wehome service. wehome can prohibit deletion and disclosure of information that is judged to be unrelated to the service or false without notifying the user in advance.

The host is obliged to make an effort not to bother the residents around the accommodations. Users should check the terms and conditions specified in wehome accurately before using the service. All losses and damages incurred due to use made without checking the terms and conditions of use are the responsibility of the user. The user must use his/her name when using the payment method for transactions.

Guests must pay accommodation, service charges and fees in their own name. The host must receive the accommodation fee in his/her financial account. The host will be paid the accommodation fee minus the service charge. The user is solely responsible for the loss and damage of The Company and the owner of the payment method caused by the use of another person’s name or payment method and the input error of the payment information. wehome can confirm the legitimate usage authority and payment completion of the user’s payment method. A user can suspend or cancel the transaction until he/she is authorized to use it and payment is complete.

 In the case of a minor transaction, if the legal agent does not agree to the contract, the minor or the legal agent may cancel the contract. wehome may cancel minor transactions without the consent of a legal representative. The host is responsible for paying taxes on the revenue generated by the rental of the inn.

The host is responsible for renting the property under the agreed terms for the duration of the agreement as soon as an agreement is reached to rent the property. The user must not link to other content or exchange personal contact information before the rental transaction of the accommodation is completed.

Article 9 (Contract Establishement, Cancellation, Fee)

 Guests can make a contract request by selecting a place to stay in wehome, displaying the date of stay, payment method, and agreement to these Terms and conditions, and then pressing the reservation request or reservation button. For accommodations that can be contracted immediately, the contract request itself means the conclusion and commitment of the contract.

Otherwise, the host or wehome takes no responsibility or obligation for the reservation contract as the contract request is not a contract. If a user is a guest, please pay the total of the accommodation rental fee and the guest fee set by wehome. Guest fees can be confirmed at the time of booking request. Only booking requests for which total cost payment has been confirmed are designated as legally valid booking requests.

The host must accept or reject the reservation within 24 hours for a legitimate reservation request that has been confirmed to pay the total cost. The reservation is completed when the host presses the reservation management acceptance button on wehome and the guest is notified of the acceptance fact. If the host does not accept or reject a legitimate reservation request within 24 hours, the reservation request will expire and the transaction will be terminated. Any amount paid by the guest to wehome due to the host’s disapproval or an expired booking request will be refunded to the guest.

Guests can cancel a confirmed reservation through wehome site. If a guest cancels a contracted reservation, the host will decide and refund the guest according to the accommodation cancellation policy agreed upon by the guest at the time of requesting the reservation. However, the service fee will not be refunded, which has exception in several countries specified below. Wehome will complete the refund request within 7 business days frome the date when the refund amount is finally resolved. There could be additional time according to the payment method or the payment gateway company a guest may use for the payment. There are three standard accommodation cancellation policies: flexible, general (ordinary), and strict. Detailed refund amount will be specified and applied separately based on the cancellation policy.

There are two types of fees for the wehome service. There is a method in which the guest and the host share the service charge and the host shares the total amount. The host can choose one of two fee models. wehome can be applied by selecting one of the two methods during the special promotion period. Detailed applicable fees are separately defined and applied in the [wehome Service Fee Policy].

The policy of the country to which the host and guest belong may adjust the cancellation policy by country. For guests of the Republic of Korea, cancellation fees are applied differently under the Consumer Protection Act than in general cancellation policies and cancellation fees.

If the host cancels the contracted reservation, the host will be liable for any damages and costs associated with the guest. wehome will transfer the accommodation fee minus the host service fee or union fee to the financial account specified by the host after 24 hours after the guest checks in under the contract according to the payment schedule.

Accommodation charges can be settled within 30 days of check-in with a separate agreement between wehome and the host.
If a guest is asked to make a valid claim within 24 hours of check-in, or if there is a significant difference in the property information posted by the host, or if a valid claim is received by the guest that is difficult to stay in, wehome will return the guest and the host will not be paid for the stay

wehome may provide additional services such as booking processing, guest support, promotions, etc. and charge accordingly if the host’s request is made. wehome may pay service fees and fees separately for additional services other than shared accommodation.

Article 10 (Contract Termination and Registration Cancellation)

The contract period of the user is not specified separately. The user’s contract may be terminated without notice. Contracts that have already occurred at the end of the contract will be selected.

 Wehome is not liable for any minor breach of companionship. wehome is not liable for fraudulent concealment or certification of guarantees for quality of service, claims based on the liability of the quality of service provided, claims for damages to life, body and health injuries, etc. This also applies to wehome employees, staff, personnel, and agents, as long as wehome’s liability is excluded or limited.

Wehome can restrict the cancellation or disclosure of accommodation registration if the information entered by the host during the accommodation registration process is incorrect or if an illegal matter occurs after the fact. If a user has a complaint about accommodation, wehome may cancel the registration of the accommodation or limit the outflow through internal evaluation.

Wehome may immediately stop the service and charge the host for his/her expenses if the information presented that wehome Home Sharing Business under special law designation is not true. wehome will only provide services to legally registered accommodations.

If the registration expires or the registration is canceled even if the registration is confirmed as a legal host at the time of registration with wehome, the host is obliged to notify wehome of this fact and delete the registered accommodation. The host is responsible for the costs and liability of failure to meet

Article 11 (Privacy Protection)

Wehome collects the minimum information necessary to fulfill the purchase contract when collecting user information.
The following items are required items, and other items are optional items.
Name, address, telephone number, e-mail address, password (for members)
When wehome collects personal information that can identify a user, we must obtain the consent of the user.

The provided personal information cannot be used for other purposes or provided to a third party without the consent of the user, and wehome bears all responsibility for this. However, this does not apply in the following cases.

If a user provides the minimum amount of information (name, address, phone number) required for delivery to the shipping company, If wehome provides in a form that does not identify a specific individual as necessary for academic research or market research, wehome shall specify or notice the information set out in Article 16 Paragraph 3 of ACT ON PROMOTION OF INFORMATION AND COMMUNICATIONS NETWORK UTILIZATION AND INFORMATION PROTECTION, ETC., set by the Korean Government, such as the identity of the person responsible for personal information management (affiliation, name and telephone number and other contact information), the purpose of collection and use of the information, and the information provision to be provided to a third party (recipient, purpose of providing, and information to be provided, etc.) and the user may withdraw this consent at any time.

Hosts and operational statistics based on wehome Home Sharing Business under special law can be provided to Ministry of Culture, Sports, and Tourism Industry of Science and ICT.
A user can request viewing and error correction of his/her personal information held by wehome at any time, and wehome is obliged to take necessary measures without delay.
If the user requests correction of the defect, wehome will not use the personal information until the defect is corrected.
To protect personal information, wehome limits the number of managers and minimizes the number of managers to prevent damage to users due to loss, theft, leakage, alteration, etc. wehome takes all responsibility.
When wehome or a third party who receives personal information from him/her achieves the purpose of collecting or receiving personal information, he/she will destroy the personal information without delay.

Article 12 (Obligations of wehome)

Wehome is a platform connect guests and hosts so that has no legal responsibility directly related for accommodation services, related information, and transaction.

Therefore, wehome is not responsible for product/transaction information and transactions. As an operator of Home Sharing Business under special law, wehome must do its best to provide quality service to hosts and guests within the institutional range.
wehome must have a security system in place to protect the personal information (including credit information) of the user and take out the personal information liability insurance of the user so that the user can use the Internet service safely.

wehome will be liable for any damages caused to the user due to the improper display/ advertising activities prescribed in Article 3 of ” ENFORCEMENT DECREE OF THE ACT ON FAIR LABELING AND ADVERTISING” for products and services.
